Privacy and cookies policy

The Privacy Policy defines the principles of processing and protection of personal data and the principles of storing and accessing information on the User's Devices by means of Cookies, for the purpose of carrying out the services provided by the ADMINISTRATOR.

Definitions

  2. Cookies - means IT data, in particular small text files, recorded and stored on the Device through which the User uses the Website.
  3. Website - means the website under which ADMINISTRATOR operates the Internet service, operating in the domain: www.krakweb.pl .
  4. Device - means the electronic device through which the User accesses the Website.
  5. User - means any person to whom services may be provided by ADMINISTRATOR, including services provided electronically.
  6. RODO - means the European Union General Data Protection Regulation 2016/679 of 27 April 2016.

Personal Data

  1. The Privacy Policy is applicable if you use the services of the ADMINISTRATOR and if you contact us via the forms available on the Service, by email, by telephone or via Facebook, Instagram, etc.
  2. Depending on the services you use, ADMINISTRATOR processes the following personal data
    1. When submitting an enquiry form on the Service: email address, name, message content, telephone number, attached file, other data provided by the User freely or according to the chosen subject of the enquiry via the form fields;
    2. When submitting a telephone contact form on the Website: telephone number;
    3. When contacting us by telephone or email: email address, name, telephone number, other data freely provided;
    4. When contacting us via social media: Facebook, Instagram, etc.: username of the portal, content of the message freely provided by the User, other data freely provided by the User;
    5. When ordering and using ADMINISTRATOR services: e-mail address, name, telephone number, company name, address and registration data, bank account number, other data provided in accordance with the nature of the cooperation undertaken.
  3. ADMINISTRATOR uses personal data in order to make ADMINISTRATOR's services available to Users, to handle complaints, to process data for accounting and tax purposes, as well as to contact the User, including the receipt and dispatch of emails in connection with or prior to the execution of the contract. The basis for the processing of the data is the processing necessary for the performance of the contract or to take action at the request of the data subject prior to the conclusion of the contract (the basis of Article 6(1)(b) RODO), and in certain cases the legal basis may also be a specific provision of law that allows the ADMINISTRATOR to process the data in order to comply with a legal obligation - such as accounting and tax regulations (the basis of Article 6(1)(c) RODO).
  4. ADMINISTRATOR uses personal data to contact Users, for example by email, including direct marketing of its own services, as well as by responding to social media posts addressed to ADMINISTRATOR, in order to better perform services, inform about changes and provide clarifications and information. The basis for processing the data is the legitimate interest of the ADMINISTRATOR (basis of Article 6(1)(f) of the DPA).
  5. ADMINISTRATOR sends commercial and marketing information to the Users at the e-mail address provided by the User or contacts the User by telephone only if the User has given his/her consent. The basis for data processing is the User's consent (basis of Article 6(1)(a) RODO). The User can opt out of receiving commercial and marketing information at any time. The withdrawal of the consent is possible e.g. by sending an email to ADMINISTRATOR at: kontakt@krakweb.pl. The withdrawal of consent does not affect the lawfulness of data processing that was carried out on the basis of consent before its withdrawal.
  6. ADMINISTRATOR requires the User to provide those personal data that are necessary for the execution of the agreement - the performance of the services or the execution of the order. If this information is not provided by the User, ADMINISTRATOR will not be able to carry out the services or orders. If required by law, e.g. tax law, ADMINISTRATOR may also require other necessary data. Apart from the above cases, the provision of personal data by the User is voluntary.
  7. ADMINISTRATOR entrusts personal data for processing to service providers who perform specific duties and functions on behalf of ADMINISTRATOR. ADMINISTRATOR makes data available to service providers with the purpose of: the implementation of hosting services, related to data storage, the implementation of services related to e-mail, mailing, the implementation of accounting services on behalf of the ADMINISTRATOR. ADMINISTRATOR entrusts to the service providers listed above only such data that are necessary for the proper performance of the services for or on behalf of ADMINISTRATOR. In the case of data transfer, ADMINISTRATOR shall ensure that the service provider shall process the data in compliance with security requirements and shall not use the data for purposes other than the performance of the services to ADMINISTRATOR.
  8. ADMINISTRATOR shall not transmit personal data to entities other than the service providers described in the paragraph above, except in cases where this is necessary due to the law or a decision of the authorities, as well as in case it is necessary to establish, exercise or defend the rights of ADMINISTRATOR.
  9. ADMINISTRATOR shall not transfer personal data outside the European Union.
  10. ADMINISTRATOR shall process the Users' personal data only for such a period as is necessary for the proper execution of the agreements with the Users, i.e. the provision of services, as well as the assertion of claims in connection with the execution of the agreement, as well as for the period resulting from the obligations imposed on ADMINISTRATOR by law (e.g. for the execution of tax and accounting obligations, in accordance with the relevant regulations for a period of 5 years), only to the extent necessary. For marketing purposes, the data shall be stored for the duration of the contract or until the User objects to such processing.
  11. ADMINISTRATOR shall ensure that appropriate technical and organisational security measures are applied to the personal data in order to ensure an adequate level of security for the personal data processed.
  12. Users have the right to access their personal data, including requesting information about their data or providing a copy of their data, processed by ADMINISTRATOR.
  13. Users have the right to have their personal data corrected if the data is incomplete, outdated or untrue.
  14. Users have the right to object to the processing of their personal data by the ADMINISTRATOR. Objection "marketing" - Users have the right to object to the processing of their data for direct marketing purposes. Objection due to a particular situation - The User also has the right to object to the processing of his/her data on the basis of a legitimate interest for purposes other than direct marketing, and when the processing is necessary for the ADMINISTRATOR to perform a task carried out in the public interest. The specific situation which justifies the ADMINISTRATOR to stop the processing covered by the objection must then be indicated. The ADMINISTRATOR will stop processing the User's data for these purposes unless the ADMINISTRATOR can demonstrate that the grounds for the ADMINISTRATOR's processing override the User's rights or that the data are necessary for the ADMINISTRATOR to establish, assert or defend claims.
  15. Users have the right to request that the ADMINISTRATOR restrict the processing of their personal data.
  16. Users have the right to request the deletion of their personal data.
  17. Users have the right to request the transfer of personal data to the User or a designated third party.

Cookies policy

  1. ADMINISTRATOR does not carry out data profiling and does not collect any information automatically, except for the information contained in cookies, if the User has consented to it.
  2. ADMINISTRATOR collects the following data contained in the cookies files, stored on the Users' Devices, intended for using the websites - type of device, operating system, type of web browser, IP, ISP, entry address, etc. - by means of cookies. This data is not combined with the data provided in Part II of this Privacy Policy.
  3. The Cookies used by ADMINISTRATOR are safe for the Users' Devices. In particular, it is not possible for viruses or other unwanted software or malware to enter the Users' Devices by this means. Cookies make it possible to identify the software used by the User and to adapt the Website to the individual needs of each User. Cookies usually contain the name of the domain from which they originate, the length of time they are stored on the Devices and the assigned value.
  4. ADMINISTRATOR collects information using Cookies for the following purposes
    1. in order to adapt the services provided on the Site to the individual preferences and needs of Users and to optimise the use of the Site;
    2. for the development of general and anonymous statistics concerning the use by Users of the Website, through analytical tools that help understand how Users use the Website, which allows to improve the structure and content of the Website;
    3. in order to provide advertising services - to present advertising content tailored to the User's preferences;
    4. for security purposes, e.g. to detect misuse of authentication on the Website.
  5. ADMINISTRATOR collects information using the following categories of Cookies
    1. temporary files, which remain on the User's Device usually until the browser is closed. Once the browser is closed, the files are deleted. Such cookies are used by ADMINISTRATOR, among other things, to remember User data.
    2. permanent files which remain on the User's Device for a certain period of time or until they are deleted by the User. The files are not deleted when the browser is closed.
  6. ADMINISTRATOR uses third-party software to analyse the behaviour of Users. The scripts provided by the software providers may use cookies to identify visitors to the Website and send information to their servers about the visitor's IP number, their web browser, their operating system and the sub-pages and files viewed. The data collected in this way is only used for statistical purposes.
  7. ADMINISTRATOR uses Google Analytics, a web audience analysis service provided by Google, Inc. ("Google"). Google Analytics uses cookies in order to make it possible to analyse how Users use the Website. ADMINISTRATOR also uses Google AdWords, a service for evaluating the correctness and effectiveness of advertising activities carried out using the AdWords network provided by Google. The information generated by the Cookies about the User's use of the Website (including their IP address) will be transmitted to Google. Google will use this information for the purpose of evaluating your use of the Website, compiling reports on website traffic for website operators and providing other services relating to website traffic and internet usage. Google may also transfer this information to third parties where it is required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data. The User may opt out of Cookies by selecting the appropriate settings on their browser, but in this case it may not be possible to use all the functions of the Website. By using the Website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
  8. Using the Website without changing the settings of your browser regarding cookies means that they will be placed on your Device.
  9. The User may change his/her cookie settings at any time. The User may block or restrict the placement of Cookies on the Device by changing the settings of his/her Internet browser. Detailed information on how to change the settings of Cookies is available in the settings of the Internet browser used by the User.
  10. Disabling or restricting the option in the Internet browser which allows the storing of Cookies does not prevent Users from using the Website, however it may have an impact on certain functionalities available on the Website.
  11. The legal basis for the processing of data contained in cookies is the legitimate interest of ADMINISTRATOR (basis of art. 6(1)(f) RODO) - improving the structure and content of the Site, statistical purposes, proper functioning and optimisation of use of the Site.
